What to do if You Have Back Pain After a Car Crash

By Butler Prather LLP on February 24, 2022

It is not uncommon for individuals involved in vehicle accidents to sustain injuries. In some cases, this includes back pain. If you or someone you care about develops back pain after a cat accident in Georgia, there are various steps you need to take to ensure your well-being and to make sure you recover the compensation you need.

1. Seek Medical Care Immediately

If you have been involved in a vehicle accident in Georgia, you need to seek medical care as soon as possible. In some cases, this may mean taking an ambulance to the hospital if the injuries are severe enough. However, even if you do not feel much pain right after a crash occurs, which is not uncommon for back injuries, you should still go to the doctor for a full evaluation. This helps ensure that you receive any needed medical care while also establishing a direct link between your back injuries and the crash.

2. Gather and Maintain Evidence

If you are able to do so at the scene of the crash, you should begin taking steps to gather evidence. If you see any eyewitnesses to the incident, jot down their names and contact information as soon as you can and before they leave the scene. If you have a cell phone or any other type of camera, take photographs of vehicle damage, causes of the crash, injuries, traffic and weather conditions, and more. Additionally, you need to keep any medical records or medical bills that you obtain in the days and weeks that follow the incident.

3. Call a Skilled Attorney

We encourage you to contact a skilled Georgia vehicle accident lawyer as soon as possible after sustaining a back injury in a crash. The earlier an attorney can get involved, the better. A lawyer will use their resources to investigate the entire incident, and they will handle all communication and negotiations with other parties involved.

4. Report the Injuries to Your Insurance Carrier

You will need to report the incident to your insurance carrier within a day or two after the incident occurs, regardless of who caused the incident. If the other driver was at fault, your insurance carrier will be the one to communicate with the other driver’s insurance carrier. However, when you make your initial report with your insurance carrier, you do not have to go into much detail. They just need to know that the crash occurred, where it happened, the name of the other driver(s) involved, and that you are seeking treatment for your back injury (and any other injury you may have sustained).

5. Continue All Recommended Medical Care

We strongly recommend that you continue all medical treatment recommended by your doctor until the doctor says it is okay to discontinue treatment. If you choose to stop going to the doctor or any follow-up care for your back injury before you have reached maximum medical improvement, this could significantly hurt your chances of recovering full compensation for your losses. Additionally, we recommend that you never accept an insurance settlement until after you have finished all medical treatment associated with your vehicle accident injuries.

I was in a complex premises liability case involving a multinational corporations. Mr. Butler & his associates were always three steps ahead of these defendants. When they say they are "exceptional trial lawyers," this is not just a slogan but it is a way of life.”
