Representing Plaintiffs that Have Been Injured by Badly Manufactured or Designed Tires

When a tire fails, the consequences can be catastrophic. Responsible tire manufacturers understand that and take steps to ensure that their tire designs will resist failure. Responsible tire manufacturers incorporate reasonable safety features, use high-quality materials and revise their designs based on how their tires are performing in the real world.

Unfortunately, some manufacturers fail to do these things resulting in serious injury and even death to unsuspecting drivers and their passengers.

Consciously Choosing To Create a Defective Product

Although the technology to make safer tires has been available for decades, some manufacturers are still designing tires without crucial features that prevent tire failure. A “cap ply,” for instance, is a textile layer placed on top of the steel belts to ensure that the belts do not separate from each other or from the carcass. Although cap plies have been available for decades, some tire makers attempt to maximize their profits by leaving them off of the tires that they build. Of course, saving costs by omitting the cap plies places unknowing customers - who are not tire design experts - at risk when the tire fails.

Other manufacturers attempt to maximize profits by building tires with low-quality components. For instance, manufacturers may:

  • Use a defective “skim stock,” which can cause the layers of the tire to separate while a vehicle is in motion.
  • Use an insufficient amount of halobutyl rubber in the “inner liner,” allowing oxygen to seep between the layers of the tire and degrade the rubber.
  • Fail to monitor the real-world performance of their tires, and fail to make the necessary design changes to keep their customers safe.

The predictable result of each these acts is that the tire maker puts its own customers at risk.
