Mr. Clay was severely brain-damaged by medical malpractice concerning anesthesia, wherein inadequate patient care in the recovery room led to respiratory distress. Prior to the injury sustained by Mr. Clay, Defendant corporation had been alerted to similar issues by both nursing staff and Dr. Miller, yet no remedial action was taken. Consequently, the verdict included punitive damages of $25,000,000 against Defendant corporation. This settlement was reached after the denial of Defendants' post-trial motions.
