Auto Product Liability / Ford Explorer Rear Restraint System / Lap Only Seat Belt
In the case of Wheeler v. Ford Motor Company, et al., the plaintiffs, Lynn and Douglas Wheeler, successfully pursued claims of design defect and failure to warn against Ford regarding the 2002 Ford Explorer. The incident occurred on Christmas morning 2005 when Lynn Wheeler, seated in the rear center seat of her son's Explorer and wearing a lap-only seat belt, was involved in a head-on collision caused by another driver. The crash resulted in a catastrophic spinal injury to Lynn Wheeler, leaving her quadriplegic. Although the driver of the other vehicle admitted fault, Ford denied responsibility. At trial, it was proven that Ford was aware of defects in the Explorer's rear seat design and its decision to delay safer design updates. The jury awarded the Wheelers $17,716,401 and found Ford acted with reckless disregard for safety, leading to an additional punitive damages phase, before Ford ultimately settled the case for a confidential amount.
